HE SAYS THE WITNESSES LIED

 

Troy Davis, his lawyers, and thousands of supporters are trying to prevent his execution. "He is innocent " they proclaim, In support of their position, they offer the affidavits of witnesses who testified against him, but since have recanted or changed their story.

 

However, Georgia courts have long held that "a post-trial declaration by a State's witness that his former testimony was false is not a ground for a new trial. " Jackson v. State, A08A1222, November 14, 2008. Davis and his supporters also claim that someone else has confessed to committing the crime. However, Georgia courts have also consistently said that a confession by another person which says "I, and not the person accused of the crime, actually committed the crime" is not admissible in favor of the accused at his trial, or to get a new trial on the basis of newly discovered evidence. Timberlake v. State, 246 Ga. 488, 491 (1980). The Georgia Supreme Court addressed each of Davis’ claims earlier this year in Davis v.
